WHAT IS A CONSTRUCTION CLAIM?
A construction claim is a formal written request for an extension of time, additional payment, variation works, project changes or other unforeseen circumstances not attributable to the contractor.
WHEN CAN A CLAIM BE MADE?
The most common reasons for submitting a construction claim include:
• Additional works not foreseen in the original Bill of Quantities
• Delays caused by the client or investor
• Changes in the client’s project documentation
• Interference or unclear instructions by the site supervision or client
FREQUENTLY ASKED QUESTIONS FROM CONTRACTORS:
1. How do I claim for additional work?
You must file a formal request, accompanied by technical and financial documentation, in accordance with the contract.
2. Who is responsible for delays in work if it’s not the contractor?
If delays are caused by the client, designer, or administration, the contractor is entitled to an extension of time.
3. What is a Construction Claim under a FIDIC contract?
It is a written request from the contractor to the employer for an extension of time, additional costs, or both – due to events beyond the contractor’s control. Under FIDIC, the contractor must submit the claim within 28 days of becoming aware of the event, and support it with technical and financial documentation.
4. How can I protect my interests during construction?
Hire experienced professionals who understand contract law, FIDIC, public procurement, and how to communicate with the client and supervision team.
